Understanding Divorce and Separation in New York

New York state law allows several kinds of separation and divorce. We'll help you determine which type provides the best resolution for your case.
  • Fault divorce
  • No fault divorce
  • Separation — for couples who are not ready to divorce, but do not want to continue living together
Prior to finalizing a divorce agreement, all of the following issues must be resolved:
  • Division of property and debt — The court will divide any debt or property accumulated during the marriage. The division will be equitable, but not necessarily equal.
  • Child custody — Custody and visitation of the children must be determined.
  • Child support — In most cases, the law requires that the non-custodial parent pays child support to the custodial parent. The court will consider the income of the parents, the needs of the child, and other factors.
  • Spousal support — One spouse may be required to temporarily or permanently pay support to the other spouse. The court will consider the length of the marriage, the earning potential of each spouse, and other factors.
